Overview


The Building Safety Act puts in place new and enhanced regulatory regimes for building safety and construction products. It will change the way Higher Risk Buildings are designed, will give residents more power to hold builders and developers to account and toughen sanctions against those who threaten their safety.

The first provisions to come into force, however, are not to do with future development, but the recovery of losses caused by both building and product defects. The new Act extends these periods significantly: for claims arising before 28 June 2022, the limitation period is now 30 years; and for claims arising after 28 June 2022 the period is 15 years.

Victoria Martin, Civil & Structural Engineering Director, BDP
Victoria is a former Trustee and Elected Council member of IStructE. She is passionate about the role of the Institution in sharing knowledge, supporting those in practice, engaging the general public and enthusing future designers. She firmly believes in taking a broad, holistic approach to engineering and in the importance of the entire team in producing elegant and sustainable designs.

Daniel Irving, Legal Director, Regulatory and Corporate Defence, Birketts
Daniel Irving is a Barrister, and Legal Director, in Birketts Regulatory and Corporate Defence Team. He has appeared in a number of prominent Public Inquiries including the Grenfell Tower Inquiry, the Undercover Policing Inquiry and the Iraq Inquiry (‘Chilcot Inquiry’). He has most recently been instructed in the Covid-19 Inquiry. Daniel also appears regularly in the Crown Court and his practice covers the full breadth of regulatory work with a particular emphasis on financial crime.

Derryn Rolfe, Legal Director, Construction and Engineering, Birketts
Derryn Rolfe is a Solicitor and Legal Director in Birketts’ Construction and Engineering team. A former engineer, she specialises in non-contentious work drafting and negotiating agreements for a wide range of projects, as well as mediations, adjudication and expert determination work. Clients include consultants, contractors, commercial and housing developers, charities government agencies, and manufacturers of a variety of products. She is advising leaseholders’ management companies and house builders on cladding remediation projects and claims.

James Humphreys, Senior Associate, Property Litigation, Birketts
James is a Senior Associate in Birketts’ Property Litigation team. He advises on a wide range of contentious property matters, but in recent years has developed a
specialism acting for clients on property matters relating to defective cladding, funding of remedial works and, most recently, the Building Safety Act 2022. James now regularly advises both leaseholders and building owners on how this developing area of law affects the landlord and tenant relationship and the disputes arising as a result.
